Terms of Service

1. The service

Vocalis is an AI-powered front-desk service for businesses. It answers phone calls, books appointments, sends reminders and follow-ups, exchanges text messages, and — where a business connects a mailbox — reads and triages email, applies labels, and prepares draft replies for a person to review. Features, pricing, and availability may change over time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use Vocalis. If you use Vocalis on behalf of a business, you represent that you are authorized to bind that business to these Terms. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

3. Connected accounts (Google, Microsoft, and others)

Vocalis can connect to third-party services — including Google (Gmail and Google Calendar) and Microsoft (Outlook and Microsoft 365) — through those providers’ OAuth authorization. By connecting an account, you authorize Vocalis to access and use the data covered by the permissions you grant, solely to provide the features described in our Privacy Policy. You represent that you have the right to connect any account you connect and to authorize this access. You can disconnect a connected account at any time, which revokes Vocalis’s access. Your use of Google and Microsoft services also remains subject to those providers’ own terms.

4. Acceptable use

You agree not to, and not to permit anyone to:

• use the service to send spam, unlawful, deceptive, harassing, or infringing content, or to send messages to recipients who have not provided the required consent;
• violate any applicable law or regulation, including telemarketing, anti-spam (such as TCPA and CAN-SPAM), privacy, and healthcare rules that apply to you;
• attempt to gain unauthorized access to the service, other accounts, or our systems, or probe, scan, or test the vulnerability of the service without authorization;
• interfere with or disrupt the integrity or performance of the service;
• reverse engineer, resell, or misuse the service or any connected-account data except as permitted by these Terms; or
• use the service in a way that violates Google’s or Microsoft’s API or platform policies.

We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the service, other users, or third parties.

5. AI-generated content

Vocalis uses automated systems to generate call responses, message replies, draft emails, and classifications. These outputs may contain errors and should be reviewed by a person before being relied upon. Drafts are not sent, and emails are not delivered as the connected account, unless a person explicitly chooses to send them. You are responsible for the messages you choose to send and the actions you take through the service.

6. Fees

Paid plans are billed as described at the time of purchase. Except where required by law or stated otherwise, fees are non-refundable. We may change pricing prospectively with notice.

7. Intellectual property

The Vocalis service, including its software, and all related intellectual property, are owned by MYNTZ INC and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. You retain your rights in the content and data you provide or connect; you grant us the rights necessary to operate the service on your behalf.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate or complete.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYNTZ INC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless MYNTZ INC from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Fresno County, California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, and you consent to their jurisdiction and venue.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
